1. ACCEPTANCE OF TERMS
BrainUp provides the following T&C, which are subject to updates from time to time. By accessing and using BrainUp services, you acknowledge that you have read, understood, and agree to be bound by these terms.

2. DESCRIPTION OF SERVICES
BrainUp offers robotics, coding, and STEM (Science, Technology, Engineering, and Mathematics) education programs, including curriculum, assessments, and training for students. Services may also include activities, personalised content, and programming tools available through BrainUp’s website and affiliated partners.

Unless explicitly stated otherwise, any new features that enhance or augment current BrainUp services are subject to these T&C. Services are provided “AS-IS,” and BrainUp assumes no responsibility for delays, interruptions, or errors in service delivery.

Classes and courses may be delivered by independent third-party providers such as schools, individual instructors, or retail locations, which are not under the direct control of BrainUp. BrainUp is not responsible for the actions of these third parties and will not be held liable for any claims or disputes arising from their actions.

3. REGISTRATION OBLIGATIONS
To access BrainUp services, you agree to:

• Provide accurate and current registration information.

• Maintain and promptly update your information to ensure its accuracy.

• Failure to provide accurate information may result in the suspension or termination of your account.

4. PRIVACY POLICY
Your registration data and any other information collected are subject to BrainUp’s Privacy Policy. By using BrainUp services, you consent to the collection, storage, and use of your information in accordance with the Privacy Policy. For more details, please refer to our Privacy Policy.

 

5. MEMBER ACCOUNTS AND SECURITY
You are responsible for maintaining the confidentiality of your account credentials. Any activity under your account is your responsibility. You agree to notify BrainUp immediately in case of unauthorized access or other security breaches. BrainUp is not liable for any damages resulting from your failure to secure your account.

 

6. MEMBER CONDUCT
You agree to use BrainUp services in a lawful manner and refrain from attempting to bypass any security measures or usage restrictions associated with BrainUp programs and materials. Any unauthorized reproduction, distribution, or public exhibition of BrainUp content is strictly prohibited.

 

7. PHOTO CLEARANCE
By agreeing to "Photo Clearance," you consent to allow BrainUp to take and use photos of participants during classes. These photos may be used in BrainUp materials such as leaflets, brochures, social media and the official website.

Use of Photos: Photos will only be used by BrainUp and will not be shared with third parties.
Storage: All photos will be securely stored in a database.

Privacy: No photos will be left on personal devices after being uploaded to secure cloud storage.
If you have concerns regarding the use of photographs, please contact BrainUp before the start of the program.

 

8. MODIFICATIONS TO SERVICES
BrainUp reserves the right to modify, suspend, or discontinue any services at any time, with or without prior notice. BrainUp will not be liable for any modifications or discontinuation of services.

 

9. REFUNDS AND CANCELLATIONS
Refunds for missed classes, dissatisfaction with services, or cancellation requests are not guaranteed and are subject to BrainUp's discretion. Any non-refundable fees will be clearly communicated at the time of registration.

 

10. DISCLAIMER OF WARRANTIES
BrainUp provides services "AS-IS" and "AS AVAILABLE." BrainUp makes no warranties about the accuracy, reliability, or suitability of its services for any particular purpose.

BrainUp does not guarantee uninterrupted or error-free services.
BrainUp assumes no liability for technical issues, missed classes, or dissatisfaction with services.

 

11. LIMITATION OF LIABILITY
BrainUp and its affiliates, officers, and employees will not be held liable for any indirect, incidental, or consequential damages arising from the use of BrainUp services, including but not limited to:

• Loss of data.

• Disruptions in service.

• Unauthorised access to accounts.

 

12. INDEMNITY
You agree to indemnify and hold BrainUp, its affiliates, and employees harmless from any claims, damages, or liabilities arising from:

Your use of BrainUp services.
Violations of these T&C.
Third-party disputes related to your use of services.

 

13. TERMINATION
BrainUp reserves the right to terminate or suspend your account without notice if there is a violation of these T&C. Upon termination, your access to BrainUp services will cease immediately, and all related data may be deleted.

 

14. PROPRIETARY RIGHTS
All materials, content, and software provided by BrainUp are proprietary and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from BrainUp content without explicit permission.

 

15. THIRD-PARTY LINKS
BrainUp services may include links to third-party websites. BrainUp is not responsible for the content or policies of these external sites. Any interaction with third-party websites is at your own risk.

 

16. AMENDMENTS TO TERMS
BrainUp reserves the right to modify these T&C at any time. Updated terms will be posted on the BrainUp website, and your continued use of services will signify your acceptance of the changes.
